All ESI replacement parts (“Parts”) sold by Engine Supply Inc. (“ESI”) are warranted to be free from defects in material and workmanship when properly installed and operated under normal use and conditions in a properly serviced and maintained machine.

This warranty is valid for eighteen months from the date of shipment or twelve months from the date of putting into service, whichever is earlier. During this period, ESI will, at its sole discretion, replace any parts that inspection reveals to be defective in material or manufacturing. Replacement parts will be provided to customers free of charge. The warranty does not cover labor to remove or replace parts.

“ESI” parts must be installed in accordance with the latest edition of the OEM workshop and installation manuals. All lubricants, fuels and coolants used must meet OEM specifications.

Customer must notify ESI in writing of any warranty claim. “ESI” reserves the right to inspect each item claimed under this warranty, as well as to inspect any relevant parts of the engine/machine and any related documentation.

Parts claimed under this warranty may not be removed from the Machine or returned to ESI prior to written authorization from ESI. Any part authorized by “ESI” to be returned must be marked with an “ESI” Return Reference (RR) number issued by the “ESI” Claims Department.

“ESI” does not warrant any of its components which have been altered from original specifications, have been misused or damaged by accident or negligence, or where engine specifications have been changed from OEM standard (eg increased power, non-standard fuel pump settings, etc.).

This warranty is provided only to direct customers of “ESI” whose accounts are not overdue, is not given to any other party, and is expressly in lieu of any other express or implied warranty. “ESI” EXPRESSLY DISCLAIMS ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Remedy under this warranty is expressly limited to the replacement parts specified above. All other claims for damages due to the failure of any part are excluded, including claims for direct or indirect economic or moral damages as well as special or consequential damages.

Any legal claim or proceeding under this warranty shall be adjudicated in the People’s Republic of China in accordance with Chinese law and must be brought in a Chinese court.
